1. About these terms

These terms govern your use of the WebSmart website (web-smart.co.uk) and any services you sign up for. By using the site or signing up to a package, you agree to these terms.

2. Our services

WebSmart provides website design, hosting, lead automation, CRM, SMS & email automation and SEO services to UK trades and home service businesses. The exact services included depend on the package you sign up to (SmartSite, SmartStart, SmartCore or SmartPro).

3. Payment

Packages are billed monthly in advance. The setup fee is invoiced at the start of the project. Monthly fees continue until cancelled. Payment is by direct debit or card, due on the same date each month.

4. Cancellation

You can cancel any time with 30 days' notice via email to [email protected]. After cancellation, your website is taken offline and access to the CRM ends. We can provide an export of your data on request.

5. Ownership

Your content (text, logos, images, customer data) is yours. The website itself — design, code and hosting — is provided as a service. If you wish to take the website with you when you leave, please ask; we'll discuss options including a one-off transfer fee.

6. Revisions

The number of revisions per month depends on your package. SmartSite and SmartStart include a fair-use limit; SmartCore and SmartPro include unlimited revisions. Unreasonable or out-of-scope requests may incur a charge — we'll always quote in advance.

7. Uptime & performance

We aim for 99.9% uptime. We're not liable for downtime caused by third-party providers (hosting, payment processors, GHL platform), force majeure or your action.

8. SEO

SEO services are provided on a best-efforts basis. We don't guarantee specific Google rankings, since rankings depend on many factors outside our control (algorithm changes, competitor activity, your local market).

9. Limitation of liability

Our maximum liability under any package is limited to the fees you've paid us in the previous 12 months. We're not liable for indirect, consequential or business losses (lost profits, lost contracts, missed jobs).

10. Acceptable use

You agree not to use our services to send spam, run unlawful activities, or upload content that's illegal, defamatory or infringes third-party rights. We may suspend or terminate accounts that breach this clause.

11. Changes

We may update these terms from time to time. Material changes will be communicated by email at least 30 days before they take effect.

12. Governing law

These terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the English courts.
